Montgomery County’s Earned Sick and Safe Law went into effect on October 1, 2016. A month later, the County amended that law to add parental purposes to the list of allowed uses of leave. We recently reported on Montgomery County’s law here.
Here is the expanded list of allowed uses. The newly added “parental” uses are in italics.
• Employee’s or family member’s illness, injury or condition or preventative medical care;
• When employee’s workplace, or employee’s child’s school or child care center is closed by a public official due to a public health emergency;
• Care for a family member whose presence in the community may jeopardize the health of others because of his or her exposure to a communicable disease, as determined by a health official or provider;
• For the birth of a child, or for the placement of a child with the employee for adoption or foster care;
• To care for a newborn, newly adopted, or newly placed child within one year of birth, adoption, or placement or
• Reasons due to domestic violence, sexual assault or stalking against the employee or family member to obtain related services, i.e. medical, legal or services from a victim services organization; or during the time the employee has temporarily relocated due to domestic violence, sexual assault, or stalking.
Because the County Council determined that adding the parental purposes was “necessary for the immediate protection of the public interest,” the amendment took effect the day it became law, November 9, 2016.
